1. The Service Model

We provide a Website-as-a-Service (WaaS). By subscribing to our Services, you are renting a digital product and hosting infrastructure. We design, build, host, and maintain a website for your business in exchange for a recurring monthly subscription fee.

2. Payment and Billing

Subscription Options: (a) No-Commitment Monthly Plan: $70.00 USD per month, cancelable at any time; (b) Annual Commitment Plan: $50.00 USD per month, requiring a minimum 12-month commitment.
Billing Cycle: You will be billed automatically on a recurring monthly basis to the payment method on file.
Failed Payments: If a payment fails, we will attempt to process it again. If the account remains past due for 14 days, we reserve the right to suspend or take down the website until the balance is paid.

3. Ownership and Intellectual Property

Your Content: You retain full ownership of all text, images, logos, and domain names that you provide to us.
Our Infrastructure: devforsmb retains full ownership of the website codebase, design layouts, architecture, and deployment infrastructure. You are granted a revocable, non-exclusive license to use the website for the duration of your active subscription. You may not transfer or migrate our code to another hosting provider.

4. Revisions and Maintenance

Your active subscription includes unlimited basic content edits (e.g., updating a phone number, changing text, swapping an image). Basic edits do not include structural redesigns, adding new complex functionality, or creating new multi-page architectures. Edit requests will be completed within 48-72 business hours.

5. Cancellation and Termination

Cancellation Process: You may request cancellation of your subscription by contacting us at support@devforsmb.com at least 7 days before your next billing cycle.
Early Termination (Annual Plan): If you are subscribed to the Annual Commitment Plan and cancel prior to completing your 12-month term, you remain responsible for the remaining monthly subscription fees ($50/month) through the end of your 1-year commitment period.
Upon Cancellation: Once a cancellation takes effect, the website will be taken offline. Because you are renting the website infrastructure, the codebase and design layouts will not be transferred to you. We will gladly point your custom domain to a new provider of your choice.

6. Limitation of Liability

We utilize enterprise-grade hosting to maximize uptime; however, we do not guarantee 100% uninterrupted service. In no event shall devforsmb be liable for any lost profits, lost data, or incidental damages arising from the use or inability to use the website.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
